The Trump Administration issued an Executive Order (EO) setting out a process for identification, review and “rescission” or modification of “unlawful” regulations and providing directives to agency heads regarding revised priorities for handling new and ongoing enforcement actions. This EO, along with the recent EO on White House oversight of federal agencies, has the potential to upend the US federal regulatory system, but appears destined to be challenged in court.
