The state of Idaho and the Alliance Defending Freedom, an American conservative Christian legal advocacy group, have appealed to the Supreme Court to allow an Idaho law that would penalize abortion providers, Carter Sherman reports for The Guardian.
Idaho is asking justices to halt a federal court decision that blocked the law on the grounds it conflicted with protections for the provision of emergency care. The Department of Justice had sued the state over its abortion law, arguing its near-total ban violated the Emergency Medical Treatment and Labor Act, which, according to clarifying guidance from the Biden administration after Roe was overturned, requires doctors at hospitals that receive federal funding to provide emergency abortions to people who need them. The ADF has rejected this interpretation of the law, and petitioned the supreme court on that basis.
