Fifth Circuit Vacates Stay of Preliminary Injunction Against Enforcement of Corporate Transparency Act (CTA) – Filings Not Currently Required


On December 26, 2024, a panel of the US Court of Appeals for the Fifth Circuit vacated a portion of an earlier order which granted the Department of Justice’s emergency motion to stay the preliminary injunction against enforcement of the Corporate Transparency Act (CTA) and its implementing regulations. On December 27, 2024, FinCEN issued an Alert noting that the stay of the preliminary injunction had been vacated and stating that while beneficial ownership information reports are not currently required, they may be submitted voluntarily.
