The US Court of Appeals for the Ninth Circuit affirmed a jury verdict finding that Google’s Play Store violated federal and state antitrust laws (In re Google Play Store Antitrust Litig., 2025 WL 2167402 (9th Cir. July 31, 2025)). The decision upholds a finding of liability against Google for monopolizing the markets for Android app distribution and in-app billing services. The Ninth Circuit rejected Google’s arguments regarding issue preclusion stemming from the earlier Epic v. Apple litigation and challenges to specific jury instructions concerning market definition and the Rule of Reason. The court also upheld the district court’s nationwide injunction.
