Legal advice privilege extends to "intra-client communications" with dominant purpose of seeking legal advice: Three Rivers (No 5) distinguished (High Court)


In Aabar Holdings SARL v Glencore plc [2026] EWHC 877 (Comm), which is an important decision for all civil and commercial litigators, Picken J distinguished Three Rivers (No 5) and held that legal advice privilege applied to certain (“intra-client”) documents that had been sent between, or created by, members of the relevant client group for the dominant purpose of seeking legal advice.
