Key Allegations: FTC Sues Prescription Benefit Managers, Group Purchasing Organizations Over Insulin Prices


On September 20, 2024, the Federal Trade Commission (FTC) issued an administrative complaint alleging that the three largest prescription drug benefit managers (PBMs) in the US and their related group purchasing organizations (GPOs) engage in anticompetitive and unfair rebate practices. The complaint alleges that these practices artificially increase the price of insulin, restrict patients’ access to lower priced products, and shift costs to vulnerable patients.
