In Blasket Renewable Invs., LLC, v. Kingdom of Spain, 2024 WL 4298808 (D.D.C. Sept. 26, 2024), the US District Court for the District of Columbia enforced an Energy Charter Treaty award against Spain, holding that the court lacked power to review the tribunal’s determination that there was a valid agreement to arbitrate under EU law. Therefore, the court had to enforce the award.
