The US Department of Justice (DOJ) filed a statement of interest in Child.’s Health Def. v. WP Co., LLC, addressing the application of federal antitrust laws to alleged collusion among major news organizations and digital platforms (2023 WL 6118520). The plaintiffs, online news publishers, alleged that the defendants, made up of various news organizations, conspired with each other to exclude rival viewpoints from social media platforms. The DOJ wrote to address application of the Sherman Act to claims involving the marketplace of ideas and to urge the court to reject a rule that would exempt viewpoint collusion from antitrust scrutiny.
