FCC Forfeiture Adjudication Proceedings Against Wireless Carriers Are Unconstitutional: Fifth Circuit


In AT&T, Inc. v. Federal Communications Commission, the US Court of Appeals for the Fifth Circuit held that the Federal Communications Commission’s (FCC’s) forfeiture adjudication proceedings against wireless carriers violate the Seventh Amendment right to a jury trial and right to adjudication by an Article III court.
