Federal Circuit Vacates Attorneys' Fees Award Based on Six "Red Flags" in Proceedings Below


In Realtime Adaptive Streaming L.L.C. v. Sling TV, L.L.C., the US Court of Appeals for the Federal Circuit vacated the US District Court for the District of Colorado’s award of attorneys’ fees, holding that the district court abused its discretion in finding the case exceptional because it did not explain the weight of the six “red flags” on which the district court based the fee award.
