In In re Princeton Equity Group, LLC, the Trademark Trial and Appeal Board (TTAB) clarified that incorporating by reference an argument made in previous prosecution filings is an insufficient assertion of that argument in an appeal brief and will result in waiver or forfeiture of that argument on appeal.
