Internet Archive's Distribution of Digital Copies of Print Books Not Fair Use: Second Circuit


In Hachette Book Group v. Internet Archive, the US Court of Appeals for the Second Circuit held that it is not fair use for a nonprofit organization to scan copyright-protected print books and distribute the full digital copies online for free without authorization from the copyright owners, even when subject to a one-to-one owned-to-loaned ratio between its print copies and the digital copies it makes available at any given time.
