IPR Findings on Prior Art Teachings Not Preclusive in District Court: Federal Circuit


In ParkerVision, Inc. v. Qualcomm Inc., the US Court of Appeals for the Federal Circuit held that Patent Trial and Appeal Board (PTAB) findings in an inter partes review (IPR) proceeding concerning prior art teachings are not preclusive in district court patent litigation because of the different standards of proof used in the two proceedings.
