JMOL of Noninfringement Under Reverse Doctrine of Equivalents Was Error: Federal Circuit


In Steuben Foods, Inc. v. Shibuya Hoppmann Corp., the US Court of Appeals for the Federal Circuit held that the district court erred in granting judgment as a matter of law (JMOL) of noninfringement under the reverse doctrine of equivalents (RDOE), finding that substantial rebuttal evidence supported the jury’s rejection of the accused infringer’s RDOE defense.
