In United States v. Apple, Inc., No. 2:24-cv-04055 (D.N.J. June 30, 2025), the US District Court for the District of New Jersey denied Apple’s motion to dismiss antitrust claims brought by the United States Department of Justice (DOJ) and various state attorneys general. The court held that the DOJ and the state plaintiffs adequately alleged that Apple monopolized and attempted to monopolize two smartphone markets in violation of Section 2 of the Sherman Act, and that New Jersey, Wisconsin, and Tennessee plausibly alleged claims under state antitrust law.
