On January 31, 2025, the US District Court for the Southern District of Texas, Houston Division, denied a Federal Trade Commission (FTC) motion for a preliminary injunction to halt the proposed vertical merger between Tempur Sealy International, Inc. and Mattress Firm Group Inc. The FTC filed an administrative complaint challenging the merger and simultaneously filed an action in federal court seeking to enjoin the merger. In denying the motion, the district court held that the FTC failed to establish a relevant product market and failed to demonstrate that the merger is likely to substantially lessen competition.
