At least five Black plaintiffs have filed lawsuits against law enforcement around the country, claiming that they were misidentified by facial recognition technology and then wrongly arrested, reports Sudhin Thanawala for the Associated Press. Critics claim that the technology, which allows law enforcement agencies to feed images from video surveillance into software that can search government databases or social media for a possible match, results in a higher rate of misidentification of people of color and some states and cities have limited its use.
Three of the lawsuits are against Detroit police, with the most recent being filed this month by Randal Quran Reid against Jefferson Parish Sheriff Joseph Lopinto and Detective Andrew Bartholomew. Reid was arrested and held in jail for several days in 2022 after being told that he was wanted for crimes in Louisiana, a state he had never been to. Bartholomew relied solely on a match generated by facial recognition technology to seek an arrest warrant for Reid. The suit accuses Batholomew of false arrest, malicious prosecution and negligence, and contends that Lopinto should be held liable for failing to implement adequate policies around the use of facial recognition technology.
