Plaintiff Bears Burden When Defendant Challenges Improper Venue: Sixth Circuit


In Tobien v. Nationwide General Insurance Co., the US Court of Appeals for the Sixth Circuit held that when a defendant challenges the plaintiff’s chosen venue as improper, the plaintiff bears the burden of proving that venue is proper by a preponderance of the evidence.
