A group of 36 of Scotland’s most senior judges are raising concerns over the implementation of juryless trials for rape cases, part of a pilot program that would have anyone accused of rape or attempted rape stand trial before a single judge or sheriff who would decide whether or not they are guilty, BBC News reports. The judges questioned whether the plans for juryless trials meet European Court Human Rights (ECHR) requirements for a fair trial, while lawyers across Scotland vowed to boycott the pilot.
Supporters of the pilot say that it could help to prevent trials from being influenced by “rape myths,” pointing to the current low conviction rate for rape by juries. The criminal justice committee will most likely consider whether ministers should be given the right to pilot juryless trials from January to mid-February.
