The CEO of non-fungible token (NFT) marketplace OpenSea announced that OpenSea received a Wells notice from the SEC indicating that the SEC is considering bringing a lawsuit against OpenSea for offering for sale certain NFTs that the SEC believes are securities. The announcement also notes an unrelated lawsuit against the SEC by other NFT artists challenging the SEC’s authority to regulate NFTs.
