In CC/Devas (Mauritius) Ltd. v. Antrix Corp., the US Supreme Court held that the “minimum contacts” personal jurisdiction standard does not apply when a court analyzes jurisdiction over a foreign state under the Foreign Sovereign Immunities Act (FSIA). All that is required for a court to find that it has personal jurisdiction over the foreign state under the FSIA is compliance with the statutory requirements, specifically that an immunity exception applies and service is proper (2025 WL 1583292 (U.S. June 5, 2025)).
