Supreme Court: Universal Injunctions Likely Exceed the Equitable Authority of Federal Courts Under the Judiciary Act of 1789


In Trump v. CASA, Inc., the US Supreme Court held that federal district courts’ universal preliminary injunctions that enjoin government officials from implementing and enforcing an executive order likely exceed the courts’ equitable authority granted by Congress under the Judiciary Act of 1789. Specifically, the universal (also called nationwide) preliminary injunctions likely exceed the courts’ equitable authority under the Judiciary Act to the extent that they provide broader relief than necessary to afford complete relief to each plaintiff with standing to sue.
