Training Competing AI Search Tool Not Fair Use of Westlaw Headnote Copies: D. Delaware


In Thomson Reuters Enterprise Centre GMBH v. Ross Intelligence Inc., a copyright infringement case concerning Ross Intelligence Inc.’s use of memos made from Westlaw headnotes to train its AI search tool, Judge Bibas for the US District Court for the District of Delaware revised his prior summary judgment opinion and granted partial summary judgment in favor of Thomson Reuters with respect to copyright infringement and denied Ross’s fair use defense.
