In NextEra Energy Glob. Holdings B.V. v. Kingdom of Spain, 2024 WL 3837484 (D.C. Cir. Aug. 16, 2024), the US Court of Appeals for the District of Columbia upheld the jurisdiction of the federal district court to hear applications to enforce intra-EU investment treaty awards. However, it reversed the lower court’s injunction preventing Spain from pursuing litigations in the European home states of two investors.
