Accused Infringer Not Liable for Customer Use of Claimed System: Federal Circuit


In CloudofChange, LLC v. NCR Corp., the US Court of Appeals for the Federal Circuit held that the accused infringer could not be held liable for direct infringement of system claims because it did not use the claimed system itself and customers’ use of the claimed system could not be attributed to the accused infringer under the doctrine of vicarious liability.
