After the Fifth Circuit Court of Appeals remanded the SEC’s short sale disclosure and securities lending reporting final rules for further economic analysis, SEC Chairman Paul Atkins directed SEC staff to evaluate the rules and make recommendations for appropriate SEC action, including potential changes to the rules and adjustments to the compliance dates.
