The US Fish and Wildlife Service (USFWS) and National Marine Fisheries Service (NMFS) published a proposed rule to delete the existing definition of “harm” under their regulations implementing the Endangered Species Act (ESA), potentially ending ESA regulation of activities that affect habitat of protected species.
